This website is operated by Goodness. Throughout the site, the terms “we”, “us” and “our” refer to Goodness. Goodness offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or becoming a member, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, members, or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to offer our Services to you.

SECTION 1 – PRIVATE CLUB MEMBERSHIP MODEL

Goodness is a private, non-profit cannabis membership club operating under the constitutional right to privacy as established in the 2018 Constitutional Court ruling (Minister of Justice v Prince). We do not sell cannabis. Rather, we facilitate access to cannabis for registered adult members through a closed-loop, cost-recovery model. All participation is limited to verified South African adults aged 18 and over.

Cannabis is provided exclusively to members who contribute toward operational, cultivation, and administrative costs. This is not a sale or purchase under South African commercial law.

All activities occur within a closed, private membership circle. Public access or resale is strictly prohibited.

SECTION 2 – MEMBERSHIP REQUIREMENTS

To access the Services, you must:

* Be 18 years of age or older;
* Be a South African citizen or legal resident;
* Use cannabis only for private, personal consumption;
* Understand and accept the legal risks associated with cannabis;
* Be approved as a member by our internal process.

We reserve the right to approve or deny membership at our discretion. Misrepresentation or misuse of membership privileges may result in suspension or termination.

SECTION 3 – CONTRIBUTIONS AND ACCESS TO CANNABIS

Members contribute toward the cost of cultivation, packaging, delivery, and administration. These contributions are not retail purchases and are not subject to commercial transaction rules.

We retain full financial records to demonstrate our non-commercial nature. Contribution amounts may vary depending on quantity, product type, and operational needs. Members may request a breakdown of contributions at any time.

Cannabis is provided in quantities suitable for personal use. Contributions are logged and capped where needed to comply with responsible use and private-use principles.

SECTION 4 – PRODUCT AVAILABILITY AND VARIATION

Strains and cannabis products are subject to seasonal variation, cultivation cycles, and availability. We make every effort to provide accurate product descriptions, but natural inconsistencies may occur.

We reserve the right to limit quantities, discontinue strains, or revise access based on responsible use, stock levels, or legal guidance.

All cannabis is provided for private, adult use only. Resale, sharing, or public consumption is strictly forbidden.

SECTION 5 – SHIPPING AND RISK

All cannabis deliveries are available only to verified members. Products are discreetly packaged and shipped to the address provided by the member.

Title and risk pass to the member upon dispatch. We are not liable for courier delays, lost shipments, or seizures by authorities. Delivery timeframes are estimates only.

SECTION 6 – OPTIONAL TOOLS

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

(j) to interfere with the security features of the Service.

We reserve the right to terminate your use of the Service for violating any of the prohibited uses.

If any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed.

SECTION 14 – TERMINATION

These Terms remain in effect unless terminated by either you or us. You may terminate at any time by ceasing to use our Services and notifying us in writing.

We may also terminate your membership at any time for breach of these Terms, behavior that endangers the Club or its members, or legal risk. Upon termination, any unused contributions are forfeited.
